1. INTERPRETATION AND VARIATION

1.1 In these Terms and Conditions the following definitions apply:

“Company” means EMBODIED PILATES

“Client” means any person that has completed and submitted an online registration form at the EMBODIED PILATES website or has been booked in via telephone which has been accepted by EMBODIED PILATES.

“Instructor” means the duly qualified staff member hired (either as an employee or self-employed contractor) to lead the session the Clients participate in.

“Registration Form” means the registration form and/or medical consent form completed by a client or an instructor of Embodied Pilates whether electronically or otherwise.

“Studio” means EMBODIED PILATES studio at 30 Alexander Road, Frenchay, Bristol, BS16 1UZ.

“Package” means the different types of packages that a client may purchase including but not limited to New Client - Private 1:1 Session, 1 x Private 1:1 Session and multiple private sessions.

“Terms and Conditions” means these terms and conditions.

“Website” means www.embodiedpilates.co.uk

1.2 Where the Terms and Condition relate to the singular it will include the plural and vice versa.

1.3 References to the masculine gender will include references to the feminine gender and non-binary and vice versa.

1.4 The Terms and Conditions are incorporated into the Registration Form, and any Package is subject to these Terms and Conditions.

1.5 The Company reserves the right to vary and revoke the Terms and Conditions from time to time which it may consider necessary or desirable for the regulation of conduct of clients and the affairs of the studio. Any such changes will be published on the website and, until revoked, are binding on clients.

1.6 The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English Courts.

2. CLIENTS

2.1 Subject to condition 2.2 when a person has completed a Registration Form, they will become a Client of the Company.

2.2 Acceptance of a person as a Client is at the discretion the Company.

2.3 The Company reserves the right to expel from the studio, suspend for a specific period, cancel or refuse to renew a package of any client whose conduct is or may be, in Embodied Pilates reasonable opinion, damaging to the character of the Studio or amounts to a breach of these Terms and Conditions or where such expulsion is otherwise in the interests of another Client. Any Client so expelled or that has their Package terminated or suspended shall forfeit all privileges of access to the Studio, it is at the discretion of the Company as to whether a proportion of/or the remaining package is refunded.

3. STUDIO OPENING TIMES

3.1 Details of session times at the studio may vary from time to time. Session times will be published by the Studio and will be available at www.embodiedpilates.co.uk

3.2 Embodied Pilates reserves the right to change/cancel session times at its discretion and will endeavour to give clients notice of such changes as is reasonably practicable. The client will be provided with an opportunity to reschedule, subject to availability or receive the session back onto their package to be used in the future in accordance with the package valid for date.

4. PAYMENT TERMS

4.1 Details of prices of Packages are available at the Studio or at www.embodiedpilates.co.uk

4.2 Prices are determined by the Company and may be altered without notice from time to time.

4.3 Payment for Packages are non-refundable unless otherwise stated in these Terms and Conditions.

4.4 Any Package must only be used by the person in whose name the Package was purchased and breach of this condition will lead to termination of the Package.

5. BOOKINGS, RESCHEDULING AND CANCELLATIONS

5.1 Clients can book, reschedule and cancel sessions for themselves via www.embodiedpilates.co.uk or via their session confirmation email.

5.2 Where a Client gives verbal consent they can also be booked in by the Studio and have their payment taken using securely stored payment details.

5.2 Clients may cancel any session booked until 24 hours prior to the session scheduled start time via the website or their confirmation email, via email to hello@embodiedpilates.co.uk or telephone.

5.3 If a Client is unable to attend the session for whatever reason within the 24 hours please notify the Studio at hello@embodiedpilates.co.uk

5.4 If a Client cancels within the 24 hours prior to the session starting or does not show this will be classified as a late cancellation/no show and will be subject to the session being counted and deducted from the Package/single session.

5.5 Cancellation of a package is only valid if the client is cancelling due to long term ill health or moving home. In this circumstance the Studio will require proof of documentation in order to process a refund of any remaining sessions from the point of cancellation.

6. MEDICAL HEALTH AND PARTICIPATION

6.1 Clients are advised not to undertake any physical activities without first seeking medical advice if they have any concerns over their physical condition. The Studio reverse the right to refuse access to any client if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such facilities.

6.2 It is the Clients responsibility to inform the Studio either via the medical consent form without omission and verbally of the presence of any changes to relevant health conditions, new or old, physical or mental that may impair their ability to tolerate exercise or increase their risk in taking part – including pregnancy.

6.3 Embodied Pilates reserves the right to refuse access to any client if they consider the health of the client concerned may be at risk by taking part in the exercise.

6.4 Clients are required to always follow the instruction of the Studio team.

6.5 Clients should not attend their sessions if they are unwell or have any infectious or contagious illness including respiratory viral infections. This is for the safety of the staff and other clients who may have impaired immune systems.

6.6 Clients are not allowed on site if they are under the influence of drugs or alcohol.

7. LIMITATION OF LIABILITY

7.1 Embodied Pilates cannot be held responsible for any session, instructor or item of Pilates equipment not being available for whatever reason.

7.2 Embodied Pilates reserves the right to alter sessions, content and equipment provided at their discretion and without liability derived from such alterations.

7.3 It is the Clients responsibility to ensure they communicate and provide constant feedback regarding their needs on terms of intensity of exercises that they feel safe and comfortable with and to inform the instructor if they are experiencing increase in pain or other symptoms during exercise.

7.4 It Is the Clients responsibility to ensure that they are capable of undergoing the routine exercise provided during the sessions and that they are in a dynamic environment where the risk of accidental injury may occur whether via a slip, trip, fall, over–exertion, sprain, strain, contusion or other injury.

7.5 Embodied Pilates accepts no liability for loss or damage to property of the client or for injury to the Client on the Studio premises or outside the premises except insofar as such loss, damage or injury is by law incapable of exclusion.

8. FACILITIES AND EQUIMENT USE

8.1 Clients are only allowed to use Embodied Pilates facilities and equipment during their booked sessions and under direct supervision of the instructor present.  The studio can withdraw all or parts of the facilities for any period at any time with notice to any or all clients if needed for any cleaning, repair, alteration or maintenance work for reasons beyond the control of Embodied Pilates.

8.2 Clients must at all times observe Embodied Pilates guidelines which may be notified to them and altered or added to from time to time. Clients are requested to comply with any reasonable directions which Embodied Pilates may issue to ensure the safe operation of the Studio.

9. PERSONAL BELONGINGS

9.1 Personal belongings are bought onto the Studio premises are their own risk and the company does not accept liability for any loss or damage whatsoever to such terms.

10. DRESS

10.1 Clients must dress appropriately for Pilates and exercise with respect to the safety and wellbeing of themselves and others. Embodied Pilates recommends the use of comfortable, stretchy and fitted attire that has no sharp or protruding buckles, zips or accessories as this can damage the equipment.

10.2 Clients such attend the session either barefoot or with grip socks.

10.3 Footwear should be removed in the hallway before entry to the studio.

11. HYGIENE AND SAFETY

11.1 No food, crockery or glass are allowed in the studio.

11.2 Embodied Pilates requests that Clients attend in a state of hygiene and cleanliness.

11.3 Notwithstanding paragraph 10.2 Clients must not walk around with verruca’s or similar foot complaints.

11.4 In the event of a fire, Clients are asked to make their way to the nearest available exit.

11.5 Smoking is not permitted at all on the Studio premises.

12. GENERAL

12.1 The Company reserves the right to refuse admission to the Studio.

12.2 Embodied Pilates may assign the benefit of the Registration Process to a third party at any time without prior notice.

12.3 A person who is not party to the registration process has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of the Registration Process.

12.4 Clients must inform Embodied Pilates of any change of home address or contact details including email. Where notice is not been given it will be assumed all communication would have been received by the client.

12.5 By providing an email address to Embodied Pilates, the Client is consenting to receiving email communications from Embodied Pilates and accepts the risk that email may not be a secure and confidential means of communication. The Company will not be liable for loss of damage suffered as a result of communication with a Client by email.

12.6 By signing agreement to the Terms and Conditions Clients agree that from time to time Embodied Pilates may take videos and phots during sessions for use on the Company website, social and marketing platforms without prior written consent. If the Client would prefer not to have images captured, it is their responsibility to notify the instructor.
